Rivur Chat App Terms of Use
These terms apply to your use of the Rivur Chat application and related services (collectively, the “Service”).
1. Services Provided
Rivur Chat provides virtual phone numbers and messaging functionality, including: (a) sending and receiving SMS/MMS with traditional phone numbers (carrier routing permitting), and (b) encrypted Rivur‑to‑Rivur messaging between Rivur users. The Service is not a replacement for your mobile phone service.
2. No Emergency Services (U.S. and Canada)
Rivur Chat does not support emergency calling (e.g., 911/988 in the United States; 911 in Canada) or emergency texting. You must maintain a traditional telephone service capable of emergency calling. Do not use Rivur Chat to contact emergency services.
3. Eligibility and Account
- Provide accurate, current information and keep your credentials secure.
- You are responsible for all activity under your account and devices.
- You must comply with applicable laws of the United States or Canada (as applicable) and your local jurisdiction.
4. Virtual Phone Numbers
- Numbers are licensed, not sold, and may be sourced from carriers and third‑party providers. Availability varies by region and carrier policy.
- We may change, reclaim, or reassign numbers when required by carriers, regulators, or for non‑payment, abuse, or inactivity. We may impose a cooling/recycling period before a number is reused.
- Delivery of SMS/MMS is not guaranteed. Some short codes, premium numbers, international routes, and 2FA/OTP messages may be blocked or unsupported by carriers.
- Forwarding, caller ID presentation, and inbound/outbound messaging may be limited by carrier, device, or regional rules.
- Number porting in/out is be unavailable.
5. Acceptable Use - U.S. (TCPA) and Canada (CASL)
- Do not use the Service for spam, harassment, illegal, harmful, or abusive activity.
- United States: You must comply with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and other applicable federal/state laws.
- Canada: You must comply with Canada’s Anti‑Spam Legislation (CASL) and CRTC rules.
- We may suspend or terminate accounts for violations, high complaint rates, or carrier/regulatory requests.
6. Subscriptions and Billing
- Purchase Channels: You can buy a subscription to a virtual phone number via in‑app purchases (e.g., Apple App Store / Google Play / Microsoft Store) or via Stripe on our website.
- Auto‑Renew: Subscriptions renew automatically until canceled. Manage/cancel in the same channel where you purchased (App Store / Google Play / Microsoft Store settings for in‑app purchases; Rivur web account for Stripe).
- Pricing and Taxes: Prices may change with notice where required. Taxes, fees, and currency exchange rates may apply based on your billing location.
- Trials and Proration: If offered, trial periods and partial‑period credits are described at purchase time.
- Refunds: Except where required by law, all fees are non‑refundable. App Store/Google Play/Microsoft Store purchases follow the respective store’s refund policies. Stripe purchases follow our web refund policy.
- Non‑Payment: Failure to pay may result in suspension, number reclamation, and data deletion per our retention policies.
7. Service Limitations
- Message delivery and media quality can be affected by carriers, networks, device settings, and third‑party systems. We do not guarantee delivery times or success.
- Some features may be unavailable in certain regions or with certain carriers.
8. Privacy
Your use of the Service is governed by our Privacy Policy. We process payments through third parties (e.g., Apple, Google, Microsoft, Stripe) and do not store full payment card data on our systems.
9. Suspension and Termination
We may suspend or terminate your access for suspected violations of these Terms, non‑payment, security risks, carrier/regulatory requests, or to protect the Service and its users. You may stop using the Service at any time. Upon termination, you lose access to the Service and associated numbers/content subject to our retention policies.
10. Disclaimers; Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES AND LIMIT LIABILITY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless Rivur Communications Inc., its affiliates, and their officers, directors, employees, and agents from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your breach of these Terms or applicable law (including TCPA/CASL).
12. Governing Law and Dispute Resolution (U.S. and Canada)
- U.S. Residents: These Terms are governed by U.S. federal law and the laws of State of Wyoming, without regard to conflict‑of‑laws principles. Except where prohibited, disputes will be resolved through binding individual arbitration under the Federal Arbitration Act; small‑claims court is permitted. You waive class actions and jury trials to the extent permitted by law.
- Canadian Residents: These Terms are governed by the laws of Canada and Province of New Brunswick, without regard to conflict‑of‑laws principles. Disputes will be resolved by binding individual arbitration or small‑claims court where permitted. You waive class actions and jury trials to the extent permitted by law.
